By accessing or using Kitchly ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Kitchly is a recipe management application that allows users to import recipes from cooking videos, manage pantry inventory, create grocery lists, and organize their cooking activities. The App uses artificial intelligence to extract recipe information from video content.

3. User Accounts

To use certain features of the App, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

4. Subscriptions and Payments

Kitchly offers free and premium subscription tiers:

  • Free Tier: Limited video imports and basic features
  • Premium Tier: Unlimited imports, AI features, and advanced functionality

Premium subscriptions are billed through the Apple App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

5. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious content or attempt to hack the App
  • Use the App for commercial purposes without authorization
  • Attempt to reverse engineer or extract source code
  • Interfere with the proper functioning of the App
  • Create multiple accounts for abusive purposes

6. Content and Intellectual Property

Your Content: You retain ownership of recipes, notes, and other content you create or import. By using the App, you grant us a license to store, process, and display your content to provide our services.

Third-Party Content: When you import recipes from third-party videos, you are responsible for ensuring you have the right to use that content for personal purposes. We do not claim ownership of recipes extracted from videos.

Our Content: The App, including its design, features, and code, is owned by Kitchly and protected by intellectual property laws.

7. AI-Generated Content

Our App uses artificial intelligence to extract and process recipe information. While we strive for accuracy, AI-generated content may contain errors. You should verify important information, especially regarding food allergies, dietary restrictions, and cooking safety.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR ANY DIETARY, HEALTH, OR SAFETY ISSUES ARISING FROM RECIPE CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KITCHLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless Kitchly from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason. You may delete your account at any time through the App settings.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
